TERMS AND CONDITIONS - RUJD

R U JD?

By submitting an application to take part in a search for potential models by JD Sports Fashion plc ("JD Sports") known as R U JD? ("RUJD?") you accept and agree to these application terms and conditions. If you do not agree with any of these terms and conditions then you should not submit an application. It is your responsibility to ensure that you review the current terms and conditions before submitting an application. We recommend that you print and store or save a copy of these terms and conditions for future reference. These terms and conditions may be updated by JD Sports from time to time without further notice to you. You can find the most recent terms and conditions at www.jdsports.co.uk/page/face-of-jd.

1. How to apply

Applicants can apply to RUJD? by downloading the JD Sports app from itunes or google play for android users and uploading a recent picture.

Applicants must apply in the way described and within the dates specified by JD Sports from time to time. Applicants may only submit one application in each 12 month period. If more than one application is received, only the first application will be accepted. No responsibility is taken for applications that are illegible, lost, delayed, misdirected or incomplete or cannot be delivered or submitted for any technical or other reason.

No snap chat lensed or filters on images submitted will be approved or considered in the process. Full length shot applications are preferred.

2. Who can apply?

JD Sports reserves the right (at its sole discretion) to decide whether applicants have met the application criteria. If the application criteria are not met, the application will be invalid. All applicants must:

• a. submit a complete and legible application in accordance with JD Sports instructions from time to time;
• b. be aged between 16-24 (applicants under the age of 18 must have the consent of a parent or guardian to apply);
• c. be a resident of the UK, Eire or the Netherlands;
• d. not have any a) criminal convictions; b) no current criminal investigations pending against them; nor c) be involved in any criminal activity or behaviour;
• e. not be an employee (or a relative of an employee) of the JD Sports group (http://www.jdplc.com/our-group/sports-fashion.aspx) or in any way be professionally connected to RUJD?;
• f. not be signed to a modelling agency or be engaged as a model by any other retailer and by applying to RUJD? applicants are confirming that by submitting an application they are not in breach of any agreement with any third party.

JD Sports reserves the right to ask applicants to provide proof of eligibility at any stage during the application process, including but not limited to, proof of identity, age and residency. Applicants acknowledge and agree that they may any time during the application process also be required to submit to a background check to ensure that the use by JD Sports of any such applicant in any advertising or publicity will not bring JD Sports into public disrepute, contempt, scandal or ridicule or reflect unfavourably on JD Sports (as determined by JD Sports at its sole discretion). JD Sports reserves the right to discontinue the application process with a potential applicant on the basis of any findings resulting from a background check.

3. Castings

If applicants are selected to attend a casting or any other step of the application process, applicants must be able to attend at the location and on the dates as specified by JD Sports from time to time (locations and dates to be determined by JD Sports at its sole discretion). JD Sports reserves the right to change any dates and/or locations communicated to the applicants at any time and without any liability whatsoever (whether on short notice or not). All applicants under the age of 18 must be accompanied by a parent or guardian to any castings or any other step that forms part of the application process. Unless otherwise agreed, JD Sports shall not be responsible for any travel, accommodation or any other expenses applicants may incur during the application process.

Whilst attending castings or any other step of the application process, applicants (and any person accompanying the applicants) must promptly follow the directions and instructions of JD Sports personnel at all times. Any failure to do so (including, but not limited to, inappropriate or offensive behaviour) may result in JD Sports requesting the applicant (and any person accompanying the applicant) to leave the relevant location and will result in the immediate ineligibility of the applicants application. JD Sports reserves the right to report any failure to comply with the directions and instructions of JD Sports personnel to the appropriate authorities.

4. Intellectual Property

By submitting an application, applicants acknowledge and agree that:

• a. all intellectual property rights associated with RUJD? (including, but not limited to, any photographs, video footage or social media posts or any other form of media taken of, submitted or published by the applicants or JD Sports (or its employees or agents) during the application process) (RUJD IP) shall vest in and be owned by JD Sports (or its affiliates) and applicants hereby grant to JD Sports (and its affiliates) exclusive permission, without payment or any other consideration, to use the RUJD IP throughout the world, for whatever purpose, in all and any media, including in printed and online promotional materials and in the advertising of JD Sports (and its affiliates); and
• b. nothing in these terms and conditions conflicts or shall conflict with any obligations that the applicant owes towards any third party so as to deprive JD Sports (or its affiliates) of the full benefit of the RUJD IP.

5. Cancellation, Selection and Offers

Without any liability of any kind, JD Sports reserves the right to cancel, suspend or postpone any part of the application process or RUJD? at any time (including upon short notice) and for any reason whatsoever. For the avoidance of doubt, by submitting an application, applicants acknowledge and agree that RUJD? is not a competition and JD Sports is under no obligation to, and shall in its absolute discretion decide whether to a) run casting days or any other step of the application process; b) invite applicants to a casting or any other step of the application process; and/or c) offer successful applicants a modelling contract or any other form of offer. Applicants acknowledge and agree that if successful, successful applicants will be required to sign a modelling contract or another form of contract and may be required to sign up to further terms and conditions. By submitting an application, applicants are confirming that they are willing and able to do so.

JD Sports shall be entitled at its sole discretion to discontinue with any application for any reason whatsoever and at any stage of the application process. Applicants acknowledge and agree that no correspondence will be entered into by JD Sports about the stages which form part of the application process, the selection of applicants or the decision of JD Sports to discontinue or continue with an application.

6. Marketing and Market Research

By ticking the appropriate opt in boxes applicants agree to be opted in to receive regular communication from JD Sports (and its affiliates) and to take part in market research. JD Sports will use personal information which applicants provide, or which JD Sports may obtain through its dealings with applicants, to sign applicants up to marketing materials provided by JD Sports (and its affiliates) and to contact applicants as part of the application process. JD Sports (and its affiliates) may also use applicants personal data to tell you about JD Sports (and JD Sports affiliates) products and offers, and for market research including analysis and development of our products and customer relationships. Applicants can unsubscribe at any time by following the instructions contained in the promotional emails. If applicants do not wish to receive marketing communication from JD Sports (and JD Sports affiliates) and do not wish to take part in market research applicants should not tick the appropriate opt in boxes.

7. Publicity

By submitting an application, all applicants agree to participate in publicity at JD Sports’ request. Applicants agree that JD Sports (or any third party nominated by JD Sports) may in its sole discretion use any applicants name, image, any relevant video footage of them and comments relating to RUJD? and their experience during the application process for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid.

8. General

These terms and conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with English law. JD Sports and the applicant irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these terms and conditions or their subject matter or formation (including non-contractual disputes or claims).

JD Sports reserves the right to withdraw an application if an applicant breaches any of the terms in these terms and conditions or if they are found to have acted in a dishonest or fraudulent manner.
